س: مرحبًا، أنا من عمان. أبرمت اتفاقًا مع شركة في الإمارات لغرض الهجرة. وكان من المفترض أن يردوا لي المبلغ المدفوع إذا لم ينجحوا في الإجراءات. لكنهم يرفضون الآن لسببين. وقد مر على الأمر شهرين. وقبل يومين، رأيت عميلًا آخر على موقعهم يشتكي من الشيء ذاته. لذا كتبت تعليقًا أنا الآخر ووصفت ما حدث معي. والآن تقول الشركة أني أشوه سمعتها لذا لن يردوا لي أموالي، كما يقولون أنهم سيتخذوا الإجراءات القانونية ضدي (وفقًا لقانون الجرائم السيرانية بدبي مادة رقم 20). لم أكذب. فقط قلت أن ما حدث لذلك العميل حدث معي أيضًا، وأنهم أخذوا مالي ولم يردوا عليّ حتى الآن. هذا كل شيء. برجاء إعطائي إجابة عما كان بإمكانهم التقدم بشكوى ضدي أم لا. أقدر إجابتك كثيرًا. أسئلة وأجوبة

Q: My ex-wife has bounced two rent cheques totalling AED 46000 from a joint account that she has been removed from 4 weeks ago. I was stopped at the border as I work for Emirates and my passport has been taken until the debt is cleared. She is willing to give her passport to guarantee the debt but will this be allowed? Forged compensation claim by the tenant for maintenance evacuation
Q: Hi. I am an owner of a studio. My tenant informed me about some floor tiles breakage. So, with his suggestion and consent, I decided to get the whole floor retiled. He agreed to move out for 3-4 days. The work was completed in exactly 4 days and I paid for the job. However, it took me two weeks before that to decide a good contractor for the job. All that while he was occupying the apartment. He only left for 4 days. Now, he has registered a case against me for compensation of AED 8000 as he lied and said he couldn`t occupy the apartment for one whole month. The mediator called me and asked me if I`m willing to pay him one month`s rent as compensation to which I refused. Now, our hearing is on 4th March. Please advise. أسئلة وأجوبة

Legal rights of the employee for termination during probation
Q: Dear Madam, I have an unlimited contract with the employer and I have not completed the 6-month probation period. The company gave me a termination letter without any warning letter before. 1. If I get a job in some other company, will I get a labour ban or not? Some people told me even if you have an unlimited contract, but your company terminated you under probation period. I must have completed 1 year to avoid the ban. Please advise me, what do I do? 2. The company gave me termination letter one day before my completion of the 6-month probation period. My question is that I joined the company on 27 August 2017 and the company gave me the termination letter on 26 February 2018, but if I count the days then it is 184 days, while 6 month means 180 days. Please advise? 3. If 184 days are considered 6 months what are my rights? Can I demand the company to pay my settlement, air tickets and half year leave salary... etc? How to change the local partner upon the request of a set up LLC buyer
Q: Hi, I have a one-year-old LLC license which is established through a business set up company. Now, due to some financial issues, I am selling my company. I have a ready buyer for this but he didn`t want to keep the existing sponsor. On the other hand, the existing business set up company does not agree to transfer the sponsor and willing to keep the sponsor who belongs to them only. Clearance of a bounced cheque case after payment
Q: Hi. I had a bounced cheque case with my ex-landlord which I recently settled. He filed a case against me. My brother paid the amount and their Local UAE National will be doing some paperwork in ON TIME government service office. Then later, he was advised to go to Court to take the NOC and pay the fine. Once the NOC is taken and fine paid, do we need to take this paper to the Police Station or Immigration to clear my name so they won`t stop me at the Airport when I enter Dubai again, or it will be done automatically? Employer's maneuvering to escape paying the end of service benefits
Q: I am the only employee in the company and my job included sales, marketing, accounting, administration and delivery. I worked using my own personal desktop, phone, internet connection and car since the company has not provided any. I started work in this Free Zone company on Dec 1, 2014, under unlimited contract and on my husband`s visa. I have resigned last Dec 11, 2017, and served my 30 days’ notice period last Jan 11, 2018. My employer was supposed to pay the final settlement on my last day but then she re-scheduled to meet on Jan 14, then on January 16 and lastly on Jan 18. Just before the day of agreed final settlement, she accused me that all my previous work emails have been allegedly deleted. She filed a complaint of Breach of Contract on Jan 18 and I also filed a complaint about her delay in paying my end of service benefits. Breach of the lease contract obligations by the landlord
Q: We moved into a villa in August 2017 and we paid one cash cheque payment to the owner who is local, as he gave us a copy of his Emirates ID and contract. In December, our water was cut and was told by ADDC that the water has not been paid since August, which we all donated and paid for as we are about 7 tenants in the villa (Studio). On the 10th of this month, a legal notice came from the court showing First Gulf Properties that the landlord should appear in the court. He didn`t show up to which. Yesterday, another same one was sent to him to appear today of which I doubt he did go because all his numbers are off. I need to know what`s my right in this. NB: This property is in Abu Dhabi and I have a copy of the landlord`s Emirates ID. I even took a picture of him and my husband with the agent, and a copy of the cheque I gave to him the day we signed the contract. Please advise me. Average time needed for issuing an employment visa
Q: After 10 days asking for an update from the employer in the UAE, he says this. What can be the possible reason for stuck? Below is the employer`s email copy: "I hope this email finds you well. Please be advised that your visa application is taking longer than expected. At this point, we are still waiting for the Labour Approval and after that, the visa paper to get posted from the Immigration System. Hence, we are trying our best to resolve the issue and our PRO is following up on the same.
