What to do if your company forces you to submit your resignation
Q: Hello & Ramadan Kareem, I`m working in JAFZA (Jebel Ali Free Zone) as a Regional Manager on a limited contract ending in 2019. I shall be completing 1 year on 16 June 2017. My Management is pressuring me to submit my resignation (with a 30-days notice i.e. defined in their offer letter) as they say I have not delivered the annual sales targets. Since I refused, the HR Manager called & threatened me with "consequences". My JAFZA contract clearly mentions 90 days notice period. Now they say that if I resign, they can offer me 90 days compensation with no gratuity & other benefits. Could you please advise, what should I do?

Health insurance for employees with family visas
Q: Good Day, Please, could you advise if as per the current UAE regulations in Dubai, is an Employer obliged to provide a Dubai Health Authority compliant health insurance to those employees in the company, who are holding ONLY work permits (labour cards) with the Employer? كيفية إلغاء تأشيرتك لتجنب المنع من العمل في حالة هروب مالك الشركة
س: لدى وافد فلبيني تأشيرة على شركة بمسمى وظيفي " موظف مكتبي " براتب 2500 درهم إماراتي، والتي ستنتهي في شهر أغسطس. هرب مالك الشركة من دولة الإمارات، لذا سيتوجب على المحكمة أن تلغي هذه التأشيرة، وعلى ما يبدو سيكون هناك منع من العمل بصورة تلقائية لمدة سنة. أريد توظيف هذا الشخص في شركتي الخاصة في دبي. هل هناك أي طريقة لرفع هذا المنع من العمل؟2017/06/08

فترة الإخطار بعدم تجديد عقد الإيجار
س: أقيم في شقة منذ سنتين. ينتهي عقد الإيجار الخاص بي في 15 يونيو. أخبرت مالك الوحدة عبر البريد الإلكتروني قبل موعد الانتهاء بمدة شهر واحد أنني لا أرغب في مواصلة عقد الإيجار وأنني سوف أترك الشقة. الآن يقول مالك الوحدة أنه كان يتوجب عليّ أن أخبره بمدة 60 يومًا قبل انتهاء العقد، ويطالب بإيجار إضافي عن مدة 30 يومًا. هل له الحق في هذا الادعاء؟ هل أحتاج أن أدفع إيجارًا إضافيًا بعد انتهاء عقد الإيجار الخاص بي؟ برجاء إبداء النصيحة.2017/06/08

Can I refund the advance paid to the seller of a car if I withdraw my offer?
Q: I paid an advance to a seller for a used car. I was supposed to pay the rest of the money and get the car registered the next day. Due to unforeseen circumstances, I couldn`t complete the deal and called it off within 24 hours. I requested for a refund of my advance amount, but the seller says he will not do that. I also found out later that he has not told the complete truth about how he got the ownership of the car. This also partially influenced by the decision to call off of the deal. We have not signed any contract saying that my advance money will not be refunded. I want to know whether I am legally entitled to the refund of my advance?2017/06/07

What to do if your former employer owes you money
Q: Assalamu alaikum, My name is Mohammed Yaseen. My concern is that my previous employer was supposed to pay me AED 3700 of my salary which is pending for one year, and I have been asking him for 6 months. Actually, he was supposed to pay me AED 11700 after the cancellation of my contract, after cancellation he paid me AED 8000 but AED 3700 is still pending. I couldn`t do anything before the cancellation because I had to move to another company as the other company will not wait for me. So, on a mutual understanding, I cancelled the contract. He also committed as documented in my official email address that he will pay me all amount, but now he isn`t receiving my calls. I have the email, WhatsApp messages...etc as a proof. Q: Dear Sir, Myself Kumar; We took one project on low-cost basis based on the client`s representative`s verbal inquiry. The contract also signed, we took 50% advance for that job also, after working in that project we found that we can not continue that job if we to do so we have to face a huge loss. Shall we claim additional variation? If they refuse to pay additional variation, shall we cancel the contract? هل عرض التوظيف (خطاب نوايا) وثيقة ملزمة قانونًا؟
س: أنا مواطن ألماني، حصلت على عرض عمل في وظيفة في المنطقة الحرة لجبل علي، والتي قبلتها بعد ذلك عن طريق التوقيع على "خطاب النوايا الخاص بالوظيفة" التي تبدأ من 9 /4/2017. بتاريخ 10/5/2017، تم إنهاء خطاب النوايا بسبب رفض الإدارة العامة للإقامة وشؤون الأجانب إصدار تصريح العمل الخاص بي. لم يعطوني سبب الرفض، وتم إخباري عن طريق موظف العلاقات العامة الخاص بالشركة أنه غير مسموح لي بالعمل في دبي. لم يسبق لي التواجد أبدًا في دبي قبل هذا الرفض. تواصلت مع المنطقة الحرة لجبل علي، ووجدت أن موظف العلاقات العامة قام بارتكاب أخطاء في تقديم الطلب. تم طلب خطاب الشركة، ولم يتم تقديمه مطلقًا. أقنع موظف العلاقات العامة الشركة بأن المشكلة في دين أبي " شيعي " ومحل ميلادي " لبنان ". أخبرني موظف العلاقات العامة أنه من غير المسموح لي أن أدخل دبي. لقد دخلت إلى دبي في 15/5/2017 بدون أي مشاكل. 1. هل خطاب النوايا ملزم قانونًا؟ لم يتضمن أي شرط بخصوص التأشيرة. 2. هل يمكنني مقاضاة الشركة طبقًا لقانون مكافحة التمييز والكراهية والمطالبة بتعويض؟ 3. هل يمكنني معرفة لماذا رفضت الإدارة العامة للإقامة وشؤون الأجانب الطلب، حيث أن الشركة ترفض المطالبة بالتوضيح؟

Q: In regards to the UAE Labor Law and the application of End of Service Gratuity, if an individual was employed by another branch of a company before transferring to an FZE branch UAE based employment contract, would that be considered continuous employment? Criminal record clearance
Q: Dear Sir, I had issued a rental cheque to the landlord while I was a partner in the company, but when I left the company I forgot to collect the cheque back and eventually the new partner did not honor the payment, which later on ended up by landlord filling case and I was apprehended at the airport in Dubai on my visit. The amount was 14,000AED which I ended up paying at the court to close the case and get back home. Now I want a Police Clearance Certificate from Dubai for my Canadian Immigration, will that case be reflected in the PCC or have an effect on the issuance of PCC? Thanks2017/06/01
