Q: I`m a partner in a UAE free zone company with telecommunications trade license. Can I open my 100% ownership firm with the same telecommunications trade license in another free zone in the UAE? Kindly advise. If not, then what is the way out? Thank you

Destiny of the customer's cheques issued before the closure of a company
Q: I wrote out post-dated cheques to a removal company. This company has now been closed by the DED, and their license expired in July 2017. This has not been renewed and it has all been confirmed by the DED. I cannot get my cheques back from them as there is no one to contact. I am afraid however that they are still going to try and encash the cheques, which have been made out to the company and not an individual. What do I do please? Dubai Police referred me to Dubai Court but I have not been successful with either of them.2017/10/04

Wrongfully accused of harassment and losing EoS gratuity
Q: Hi, I need advice. I have been working for the last 30 years, and the last 10 years were with one company. I have received termination stating harassment while requesting for a face to face check with the people, facts were not disclosed. Now, they have informed me that they`ll detain my gratuity amount which I feel I deserve. Harassment case - it was a complaint raised by few colleagues stating improper touching, which was not the actual case. Hence, received a termination for the same. Never given a chance to speak. However, I have not been such a person and have not done such a thing in overall 30 years of service. Now, gratuity has been held considering the harassment clause.

Am I liable for the mobile service contract signed by my friend who used my ID?
Q: My friend used my civil ID to order a mobile phone from a mobile company. It is payable for six months. She paid 2 months but the mobile got broken and she asked replacement from the company. The company took the phone but did not give any replacement thus my friend did not pay her outstanding balance. Now they are calling me asking me to pay the balance and penalty. Why am I going to pay penalty and balance where in fact the mobile is in their possession? Am I getting sued for letting my friend use my ID? Note that I didn`t sign any papers from the company. They are threatening me that if I will not pay they will send police to arrest me.

Can my employer prevent me from getting a new job in UAE by imposing travel ban?
Q: Dear Sir, Currently, I am working as a production supervisor in Kuwait and recently I have resigned from my job. The reason was - I got a better offer from the UAE. My current employer tried to convince me to stay here but I refused for some reasons. Now he is threatening me like "You can`t move to UAE because I am going to ban your UAE travel". Please advise me, is it possible to ban my UAE travel without any valid reason? If they made any reason what would that be?2017/10/03

Neutral party entrusted with the belongings of divorcing couple
Q: I was requested by a couple who were leaving the UAE to retrieve their belongings, as they could not fit them into their luggage. One of them is my friend and co-worker, and the other is a Swiss national whom I only know via my friend. The instructions were to hold on to the belongings until they were able to send me an address and money to ship them to their new location in the USA. In the short time they`ve been in the USA, a string of events had led them to separate. The Swiss national moved back to Switzerland and has been making legal threats and physical harm threats to me if I do not send his belongings to him. Since the bags contain both of their belongings, I have decided to send the bags to my friend in the USA so that the belongings can be divided in front of a divorce lawyer. Does this break any legal grounds on my part? He is making threats to open cases in Dubai and the EU. Is this possible based on these grounds?2017/10/03

الجرائم الإلكترونية وأهمية الدليل في رفع دعوى قضائية
س: قام أحد الأشخاص بإنشاء حساب باسمي على موقع فيسبوك، واستخدم برنامج فوتوشوب للصق صورة لوجهي على جسد فتاة عارية، ثم وضعها كصورة شخصية للحساب. أنا متأكدة أن زوجي هو من قام بذلك لأنني أقوم بإجراءات الطلاق منه الآن، لكن ليس لديّ دليل على ذلك. قمت بأخذ لقطات شاشة لكل شيء وأبلغت الخلية الإلكترونية لكنهم لم يفعلوا أي شيء. والآن قام هذا الشخص بحذف الحساب، وأنا أريد أن أتعقبه وأثبت ما فعل لأنه سبب لي الكثير من المشاكل في حياتي. برجاء مساعدتي وإخباري بما يمكنني فعله الآن.

الاستقالة خلال فترة التدريب بسبب التحرش الجنسي
س: اسمي روي. أنا مواطن فيليبيني أعمل بالمنطقة الغربية من إمارة أبو ظبي كمعالج بالتدليك منذ شهرين. أعمل بعقد محدد المدة، وأريد أن أقدم استقالتي بسبب مناخ العمل غير الصحي بالشركة. الأمر يتلخص في أنني مررت بعدة تجارب سيئة مع الإدارة والعملاء، حيث أن أكثر العملاء يجبرونني على ارتكاب أفعال جنسية مشينة مثل تدليك أعضائهم التناسلية ولعقها وغير ذلك. لا أستطيع تحمل الأمر أكثر من ذلك وأريد أن أستقيل لأن العمل هنا مؤذٍ نفسيًا وعقليًا بالنسبة لي. كيف يمكنني المغادرة دون التعرض للعقوبة؟ مع العلم أن مديري ورئيس الشركة لم يسمحوا لي بالاستقالة ولا يفهمون ما أمر به من خوف وصدمة. أحتاج لمساعدتك.2017/10/03

استئناف حكم ترحيل شخص بسبب تعاطي الحشيش
س: مرحبًا، تم القبض على ابنتي من منزلنا بدبي في يوم 29 أغسطس لتعاطي المخدرات. كنا قد عدنا من الإجازة قبل ذلك بأسبوعين وقامت ابنتي بتعاطي الحشيش حينها. والآن مرّ على حبس ابنتي شهرًا وكانت جلسة الاستماع بالأمس، وقد صدر حكمًا بتغريمها 5000 درهم بالإضافة ترحيلها من الإمارات وسوف نستأنف على هذا الحكم يوم الأحد. والسؤال: ما تكلفة استصدار حكم بإطلاق سراحها بكفالة؟ هل يمكن إلغاء حكم الترحيل؟ نحن نعيش في دبي منذ 30 عامًا وليس لدينا مكان آخر نرسلها إليه.2017/10/02

Q: Hi, I have a company that designs and manufactures solar powered products. I do the design and the products are manufactured by local workshops. I would like to draw a contract/agreement with the workshop to guarantee the work for my client. I would like this to be legally binding. Q1: How can I make this agreement legally binding so the supplier can fix any problems with the product should any come up?
