Employer failed to process my visa and Emirates ID and I have heavy fines. What are my options?
Hello,
I’ve been working for a company for 8 months now. They only gave me an eVisa (Change Status), but it has already expired.
I have always told them about my visa and Emirates ID, but I still haven’t received either.
I have too many fines now. What should I do?
Greetings,
If your employer has not processed your residency visa and Emirates ID despite your continuous requests, this is a serious violation of UAE labor laws.
You may be eligible to file a complaint with the Ministry of Human Resources & Emiratisation (MOHRE) or the free zone authority (if applicable). Additionally, fines due to your employer's negligence may be contested.
To understand your legal options and protect your rights, book a consultation with us to act on your behalf.
Hello,
An E-visa is usually a temporary arrangement while the company processes your full employment visa and Emirates ID.
Once the E-visa expires, you are legally required to have a valid work visa and Emirates ID. If the employer is not taking any action, you can file a complaint with MOHRE.
They are responsible for labor rights in the UAE, and if your employer is not fulfilling their obligations (such as providing you with a valid visa), they can intervene.
You can file a complaint through the MOHRE website or app.
Dear Questioner,
Thank you for your inquiry. Here’s an outline of your situation and next steps:
1. Employer's Responsibility:
Your employer is legally obligated to provide you with a valid work visa and Emirates ID. Since your e-visa has expired, this constitutes a violation of UAE law on their part.
2. Fines for Overstay:
You are accumulating fines due to overstaying, which can continue to increase. It's crucial to address this issue immediately.
3. Next Steps:
- Notify your employer formally, in writing, to demand immediate action to process your visa and Emirates ID.
- Contact ICA or GDRFA to inquire about your visa status and fines, and explore options to resolve the overstaying issue.
If your employer does not act, you may consider filing a complaint with MOHRE or pursuing legal action for breach of employment obligations.
Please let me know if you need further assistance with any of these steps.
Best regards,
Mohammed Salah
