Hired from abroad but fired without proper tools or training. What are my options?

Hello,

They hired me from London and, within a month or two, are considering firing me even though they haven’t provided the tools or training needed for the job.

Do I have legal grounds to sue if I am let go?

You may have legal grounds to sue if terminated under these conditions; however, consulting with an employment lawyer is crucial for personalized advice based on specific details of your case.

Wishing you a pleasant day ahead,

If you were hired and relocated for the role, but the employer has failed to provide the necessary tools, training, and support to perform your job effectively, you may have grounds to challenge any termination, depending on the employment laws in place.

While the specifics depend on your contract and local labor laws, you could potentially say that you were not given the required resources to succeed in the role, which could constitute unfair treatment.

Best Regards,

Dear Inquirer,

If you were hired with specific expectations, and your employer has failed to provide the necessary tools and training to perform your duties, this could potentially be a breach of your employment contract.

However, if you are let go, your legal options will depend on the terms of your contract, the reasons for termination, and the labor laws in place.

You may have grounds to claim compensation if the termination is unfair or if the company has not met its contractual obligations, such as providing the proper resources for your role.

We strongly recommend consulting with a legal expert to evaluate your situation thoroughly and explore the best course of action.

Book a consultation with us to receive tailored legal advice and determine your options.

Dear Questioner,

Thank you for your inquiry!

Based on your situation, I would like to outline the process for filing a complaint for unfair dismissal under UAE labor law, particularly when an employer fails to provide the necessary tools and training.

- Employer Responsibility:

Under UAE law, employers are required to provide employees with the necessary tools, equipment, and training to perform their duties effectively. Failure to do so could be considered a violation of your rights, especially if it leads to termination.

- Filing a Complaint:

If you believe your dismissal was unfair, you must first file a labor complaint with the Ministry of Human Resources and Emiratization (MOHRE). The MOHRE will attempt to mediate a resolution between you and your employer.

- Labor Court:

If mediation proves unsuccessful, the matter can be referred to the labor court, where you may present your case. In court, you can argue that your dismissal was unjustified due to the employer’s failure to provide the necessary tools and training.

- Possible Outcome:

Depending on the specifics of the case, the court may order your employer to provide compensation for any losses incurred as a result of the termination.

Given the complexity of the situation, I recommend that we discuss your case further to ensure the appropriate steps are taken. Please feel free to reach out for any clarification or further assistance.

Best regards,

Mohammed Salah

I understand your concern regarding your employment situation. In the UAE, employment rights are primarily governed by your contract and UAE labor laws.

If your employer has not provided the necessary tools and training as per your contract or company policies, you may have grounds to challenge an unfair termination.

However, the strength of your case depends on various factors, including the terms of your contract, probation period clauses, and any commitments made by your employer. I can review your employment contract and advise you on the best course of action to protect your rights.

Please reach out to me via WhatsApp or phone to discuss your case in detail and explore your legal options.

Best regards,

Suhail Rana

Hello,

The contract should specify a notice period for termination. In general, if you're terminated without cause, the employer is usually required to provide notice or pay in lieu of notice.

Check if the contract clearly outlines your job duties, the tools, and the resources necessary for your role. If the employer has failed to provide you with the tools or training required to perform your job as outlined in the contract, you may have grounds for a claim for failure to fulfill contract obligations.

Thank you, Khaled!

The Contract is vague and makes no mention of a probation period, but in their Company manual, it mentions that training will be provided.

Do you have a number or WhatsApp where I could potentially reach you?

Dear Sir/Madam,

Thank you for your inquiry regarding potential legal grounds in the event of termination during your probationary period in the UAE.

Below is a professional response based on the UAE Labour Law (Federal Decree-Law No. 33 of 2021) and its provisions.

1. Legal Grounds for Termination:

Under UAE Labour Law, employers are allowed to terminate employees during the probationary period, provided they comply with specific legal requirements:

- Notice Period: As per Article 9 of the UAE Labour Law, employers must provide a written notice of at least 14 days before terminating an employee during probation.

- Legitimate Reasons: Termination must be based on valid reasons, such as underperformance or failure to meet job requirements. Arbitrary or discriminatory dismissal is prohibited.

If your employer fails to provide proper notice or terminates you without valid justification, you may have grounds to file a complaint for arbitrary dismissal.

2. Arbitrary Dismissal:

Termination is considered arbitrary if:

- It is not based on performance, conduct, or operational necessity.

- It is discriminatory or retaliatory (e.g., related to filing a complaint against the employer).

If you believe the termination is arbitrary, you can file a complaint with the Ministry of Human Resources and Emiratisation (MoHRE). If proven, the court may award compensation of up to three months' salary, in addition to any unpaid dues such as notice period pay and end-of-service benefits.

3. Lack of Tools and Training:

If your employer has not provided the tools or training necessary for you to perform your job effectively, this could weaken their justification for termination. Employers are expected to provide adequate resources and support to enable employees to meet their job requirements.

4. Steps You Can Take:

a. Document Your Case:

- Keep records of all communications with your employer regarding tools, training, and performance expectations.

- Retain copies of your employment contract and any termination notice.

b. File a Complaint with MoHRE:

If terminated, you can lodge a complaint with MoHRE through their online portal or service centers.

MoHRE will attempt to mediate between you and your employer. If no resolution is reached, the case will be referred to the labor court.

c. Seek Compensation:

If arbitrary dismissal is proven, you may claim up to three months’ salary as compensation, along with any other unpaid dues (e.g., gratuity or notice period pay).

4. Consult Legal Assistance:

Engage a lawyer experienced in UAE labor law for guidance and representation if needed.

5. Key Considerations:

If your employment contract specifies a probationary period, termination during this time is generally easier for employers but must still comply with legal requirements.

The lack of tools and training provided by your employer could strengthen your case if termination occurs.

While employers have the right to terminate employees during probation with proper notice and valid reasons, failure to provide adequate tools or training could undermine their justification for dismissal. If terminated unfairly, you may have legal grounds to file a complaint and seek compensation through MoHRE.

Should you require further assistance or legal representation, please do not hesitate to reach out.

ABDUL WAHIED
