Can I skip my new job's health insurance and stay on my spouse's plan instead?

Hello,

I have a new job, and I was planning not to take the health insurance from my new company.

Instead, I will use the health insurance under my wife's company, as the benefits are better.

Is it possible to do this?

Congratulations on your new job!

In Dubai, it is mandatory for employers to provide health insurance to their employees under the Dubai Health Insurance Law.

However, in certain cases, if you are already covered under a spouse's insurance policy that meets the minimum requirements set by the DHA, some companies may allow you to opt out of their insurance plan.

That being said, this depends on your employer’s internal policies and whether they permit such an arrangement.

I recommend reviewing your employment contract and discussing this directly with your HR department.

If you need assistance in reviewing your contract or ensuring compliance with legal requirements, feel free to reach out to me on WhatsApp or phone at [----------], and I’d be happy to guide you further.

Best regards,

Dear questioner,

The employer is responsible for providing health insurance for the employee. However, in some cases, the company may allow the employee to use an alternative health insurance plan, such as their spouse’s insurance, provided that sufficient proof is given that the coverage meets legal requirements.

It is advisable to check with your new company’s HR department to explore available options.

Dear Valued Employee,

Thank you for your inquiry regarding health insurance options with your new employment!

I appreciate your proactive approach to ensuring optimal coverage for your healthcare needs. Please allow me to provide a professional assessment of your situation based on UAE labor laws and health insurance regulations.

Key Points:

1. Mandatory Employer-Provided Insurance:

As per UAE Federal Law No. 7 of 1999 and subsequent amendments, employers are legally obligated to provide health insurance coverage for their employees. This is a non-negotiable aspect of employment in the UAE.

2. Single Active Policy Rule:

UAE health insurance regulations prohibit individuals from holding multiple active health insurance policies simultaneously. This rule is in place to prevent overlapping coverage and ensure clear accountability in claims processing.

3. Employer Compliance:

Your new employer must comply with legal requirements by providing you with health insurance coverage, regardless of any existing coverage you may have through your spouse's plan.

4. Policy Cancellation and Transfer:

In certain emirates, such as Abu Dhabi, there are specific procedures for canceling existing group health policies before obtaining new coverage. This further underscores the inability to simply opt for an alternative policy.

5. Recommendation:

While it's understandable that you wish to benefit from the superior coverage offered by your wife's company insurance, declining your employer's insurance is not a legally viable option.

We recommend accepting the insurance provided by your new employer to ensure compliance with UAE regulations.

6. Additional Considerations:

- You may explore the possibility of upgrading your employer-provided insurance for a fee if such an option is available.

- Consider discussing with your HR department any flexibility in choosing insurance providers or plans within the company's offerings.

If you have any further questions or require additional clarification, please don't hesitate to reach out to your HR department or a legal professional specializing in UAE labor law.

Sincerely,

Greetings,

In Dubai and Abu Dhabi, employers are generally required to provide health insurance to their employees as per local regulations.

While you may prefer to use your wife's insurance, your new employer may still be obligated to offer and enroll you in their plan. However, there are cases where an exemption might be possible.
