A company in the UAE failed to provide the service we paid for. How can we refund our money?

We are a UK-based company that paid for a UAE agency to complete a photoshoot for us. Some time passed as we were struggling to schedule a shoot in our schedule.

They also delayed the matter due to a lack of availability for them. They promised us a shoot by November but then stopped responding to us.

We threatened legal action and now they are only offering a refund of approximately 18%.

Please could you advise me on how to move forward as they have cheated us?

If the agency does not implement the agreement, you can request a full refund or file a legal claim for compensation.

Start with official correspondence and file a complaint with the relevant authorities such as the DED (Department of Economic Development).

We can send them a legal notice and demand the performance of the contract or refund you the full money paid with legal interest.

Further, we need to review the terms of the contract in order to advise you properly.

Hello,

Before escalating the matter legally, send a legal notice to the agency. This notice should outline your complaint for the failure to fulfill their obligations and your demand for a full refund or compensation for the breach.

If the agency does not respond to your legal notice or refuses to provide a full refund, you can file a complaint with the Department of Economic Development (DED) and also you can file a civil suit in the Dubai Courts to recover your full payment.

What you agreed upon in a contract with obligations on both parties, if one party performs a specific task and fails to fulfill his obligation, the other party may prove this failure and request the termination of the contract with compensation to compensate for the damage.

First you may approach by sending a legal notice. Clearly outline the services you paid for and the specific breaches of contract by the agency.

Demand full reimbursement or specific performance (i.e., completing the photo shoot). Set a reasonable deadline for their response.

Collect emails, messages, and any other communication with the UAE agency. Maintain records of all payments made to the agency.

If they are not responding to the legal notice within the time frame, we will be filing the case in the competent court.

Sure. The charge will 3500 AED, including drafting, Translation, power of attorney, Notary attestation Service and Notary attestation fee including Aramex charges.

If you have a clear and explicit agreement, evidence that you paid them, and proof that they did not honor the agreement, your option is to file a case against them in UAE courts.
