Do daughters have the right to know information about a business fully inherited by mother from father?

Dear Lawyers,

My deceased father owned a business in the UAE. He has a will stating that all property and the ongoing business go to my mother after him.

My brother is part of the business, and my mother stays with him. I want to know, as per UAE law:

1. Do married daughters have any rights to be informed about the business's health?

2. Can married daughters claim any share or role in decision-making for the business, given that the will states that after my mother, the inheritance will be equally shared among siblings?

Dear Questioner,

As a daughter and an heir, you typically have a right to know about the business's general status, especially since you have an inheritance interest in it after your mother.

However, the law does not specifically mandate that you be informed of the business’s daily or operational details unless you are formally involved.

Practically, this means your mother, as the current owner per the will, may provide information as she sees fit, but if you anticipate an inheritance, it is reasonable to expect periodic updates about the business.

As the will designates your mother as the immediate heir to all assets, she currently has ownership rights, including decision-making authority over the business.

After your mother, the business and assets should be distributed among siblings equally, as per the will’s terms.

At that time, you would have a legitimate claim to both your share and a role in business decisions, depending on the final distribution and management structure.

Dear Questioner,

1. According to UAE Law, married daughters do not have any rights to know about the business's health unless they are specifically named in the will as beneficiaries or have been given a power of attorney by their father to manage the business.

2. Inheritance laws in the UAE are based on Shariah principles, which state that male heirs are entitled to a larger share of the inheritance compared to female heirs.

In this case, if your father's will states that the inheritance will be equally shared between siblings, then it may not be in accordance with Shariah principles and may not be recognized by the UAE courts.

Dear Questioner,

Under the laws of the UAE, the law of inheritance and Islamic law apply with regard to the distribution of the estate to non-Muslims, but a person can stipulate in his will that his property be distributed as he wishes, and the will will be executed accordingly as long as it is in line with the UAE law.

1. Rights of married daughters to know the health of the company:

- Right to information:

If the company is fully owned by the heirs, married daughters can demand to know the health of the company and to see its financial status and financial performance to ensure their future rights, especially if the estate is shared between them according to the will.

- Contact a lawyer:

In the event of a dispute over the right to access information, daughters can consult a lawyer to ensure that their rights regarding the company are implemented and to follow up on financial matters.

For assistance, please contact us via phone or WhatsApp at [----------].

2. Claiming a share or role in decision-making regarding the company:

- Future ownership right:

Since the will stipulates that the company will be transferred to your mother and then divided among the siblings after her death, daughters have the right to claim a share of the company after the mother’s death according to what is stated in the will.

- A role in decision-making:

During your mother’s life, other children are not given a role in decision-making unless the will or company agreement gives them this right. However, after the inheritance is transferred to them, they can participate in decision-making as actual partners.

It is preferable to document any agreements or understandings regarding the company and its financial status, and you can review the will with a lawyer specializing in inheritance law in the Emirates to ensure that your rights to the estate are protected according to the law and the will.

Welcome,

Thank you for getting in touch!

Under UAE law, married daughters do have rights related to inheritance, especially when it concerns their share in their father’s estate.

Here’s a breakdown of your queries:

1. Right to Know About Business Health:

- Current Status:

While your father’s will grants the entire business and property to your mother, if you are an heir according to the will, you have an interest in understanding the business's status, particularly if your mother’s inheritance includes your eventual share.

- Practical Access:

Legally, you don’t have direct rights to view the business finances until your inheritance share becomes active (upon your mother’s passing or any other condition stated in the will).

However, you can make a formal request through family channels or, if needed, apply for limited disclosure through a legal avenue, especially if there's concern over asset management.

2. Right to Claim a Share or Be Involved in Business Decisions:

- Inheritance Rights:

Since the will specifies that the business assets are to be equally shared among the siblings after your mother, you and your siblings are designated beneficiaries in succession.

However, until the inheritance becomes effective (i.e., after your mother’s tenure), you don’t have a direct legal claim to make decisions.

- Legal Standing as Future Heir:

You may not directly interfere in decision-making under current circumstances, but you could inquire or seek information on behalf of your inheritance rights to ensure that your eventual share is protected, particularly if there is potential mismanagement of assets.

Given that your interests are acknowledged in the will, it would be beneficial to keep a record of key business developments and ensure the proper execution of the will’s terms with legal support if needed.

Consider consulting a UAE inheritance lawyer to explore preventive steps for safeguarding your interests in the business.

To better understand your needs and provide you with tailored advice, could you kindly share your contact details?

If you'd like, we can also schedule a phone call or a meeting to discuss your matter in more detail at a time that works best for you.

Please let me know your availability, and I’ll be happy to arrange a convenient appointment.

Looking forward to assisting you!

Best regards,

Hi,

Good morning!

UAE inheritance laws are complex and subject to change, and your rights and interests may vary depending on the specific circumstances of your case.

Under UAE inheritance law, married daughters have the right to inherit from their deceased father, regardless of their marital status.

The specific share they will receive will depend on the number of children and other heirs. The ownership and management of the business will depend on the specific legal structure of the business and any agreements in place.

As a beneficiary of the inheritance, you may have certain rights to information about the business, but your ability to participate in decision-making will depend on the specific circumstances and any agreements in place.

For further assistance, kindly share your contact details.

Thank you for reaching out with your inquiry regarding your late father's business and the implications of the will under UAE law!

I understand how important this matter is for you and your family.

To address your questions:

- Rights to Know About Business Health:

As per UAE law, married daughters do not have an automatic legal right to be informed about the business's health, unless specified in the will or if there are provisions made by the company itself.

However, given the situation, it may be beneficial for you to have transparency regarding the business's operations, especially since the will indicates future inheritance rights.

- Claiming a Share in Decision Making:

Regarding decision-making rights, if the will specifies that after your mother, the inheritance will be equally shared between siblings, you would indeed have a claim to participate in the business decisions, contingent on the legal structure of the business and the agreements in place.

It may be necessary to engage in discussions with your mother and brother to clarify these aspects and ensure your rights are acknowledged.

I recommend consulting with a legal professional to review the will and the business structure in detail.

If you would like to discuss this further or need assistance in navigating this situation, please feel free to reach out to me directly via WhatsApp, phone, or email.

Best regards,

Dear Questioner,

Married daughters have inheritance rights under UAE law. The exact share they inherit depends on the specific circumstances, including the number of children and other heirs.

While there's no explicit right to know about the business's health, it's generally advisable to maintain transparency within the family, especially when it concerns shared inheritance.

However, the extent of information you can access may depend on your mother's decisions and the specific circumstances.

The will is a crucial document that outlines your father's wishes regarding the distribution of his assets and the management of his business.

If the will explicitly states that your mother is the sole beneficiary and decision-maker, it may limit your involvement in the business's decision-making process.

As per UAE law, married daughters can inquire about business health but do not have an enforceable right to detailed disclosures.

You can claim a share of ownership after your mother’s passing as per your father’s will; however, until then, decision-making authority rests with her.

If your religion is Islam, this is possible. If you follow another religion, it is not allowed, and the will shall be executed exactly as it is.
