Does the prenuptial agreement need attestation before filing the marriage application?

Dear Sir/Madam,

My partner and I are non-Muslim expatriates who want to apply for a civil marriage in Dubai.

I'm looking for a lawyer to draft a prenuptial agreement to submit along with the marriage application in Dubai.

Should the agreement be attested and legalized before it can be filed with the marriage application?

Dear Questioner,

According to UAE law, a prenuptial agreement is not a requirement for a civil marriage in Dubai.

However, if you and your partner wish to have a prenuptial agreement, it is recommended to have it drafted by a lawyer and notarized by a notary public in the UAE.

The agreement does not need to be attested or legalized before it can be filed with a marriage application.

However, it is advisable to have the agreement translated into Arabic and have it notarized in both English and Arabic to ensure its validity in the UAE.

It is also important to note that the prenuptial agreement must comply with UAE laws and cannot violate any provisions of Sharia law.

It is recommended to consult with a lawyer who is familiar with UAE laws and can assist you in drafting a valid prenuptial agreement.

Hello dear questioner,

Both spouses are required to be at least 21 years old.

Both spouses must express their desire to consummate the marriage, provided that the expression of consent is legally valid, meaning that it is not tainted by any defect such as coercion or negligence.

A disclosure form prepared in advance for this purpose must be signed. This includes an acknowledgment that there is no existing marital relationship and does not require the approval of the father or guardian, the husband’s medical examination, or the presence of witnesses to complete the marriage.

It is required that the marriage not be between brothers, sons, grandchildren, paternal uncles, or uncles.

After verifying all the previously mentioned marriage conditions, for example but not limited to, the notarization judge ratifies the marriage contract and records it in the private registry, thus completing the marriage.

Dear Questioner,

If some conditions are agreed upon, you can add them to the marriage contract, or authenticate them independently in the family court.

Dear Questioner,

Thanks for your inquiry!

According to UAE law, a prenuptial agreement is not a requirement for a civil marriage in Dubai. However, it is recommended to have one in order to protect the rights and assets of both parties in case of a divorce.

If you and your partner decide to have a prenuptial agreement, it is not necessary for it to be attested and legalized before filing it with the marriage application.

However, it is advisable to have it notarized by a public notary in order to make it legally binding.

It is also important to note that the prenuptial agreement should comply with the laws and regulations of the UAE and should not contradict any provisions of the Personal Status Law.

It is recommended to seek the advice of us as a lawyer who is familiar with UAE laws to draft the prenuptial agreement.

Kindly do not hesitate to contact us via phone or email for further guidance in your specific case.

Greetings,

Dear Questioner,

In Dubai, non-Muslim expatriates have the option to enter into a civil marriage, which is governed by the Personal Status Law No. 28 of 2005.

As part of the civil marriage process, couples may choose to create a prenuptial agreement to establish their rights and obligations regarding property, finances, and other matters.

Here's what you need to know about prenuptial agreements and their requirements in Dubai:

1. Content of the Agreement:

A prenuptial agreement typically outlines how assets, debts, and financial matters will be managed during the marriage and in the event of divorce or separation. It may address issues such as property ownership, inheritance rights, spousal support, and division of assets.

2. Legalization of the Agreement:

While prenuptial agreements are not mandatory for civil marriages in Dubai, they can provide clarity and protection for both parties. The agreement should be drafted by a qualified lawyer who is familiar with family law in Dubai and the requirements for prenuptial agreements.

3. Attestation and Legalization:

In Dubai, prenuptial agreements do not necessarily need to be attested or legalized before they can be submitted along with a marriage application. However, it's advisable to have the agreement drafted in accordance with UAE law and signed in the presence of witnesses to ensure its validity and enforceability.

4. Legal Advice:

It's important for both parties to seek independent legal advice before entering into a prenuptial agreement. A lawyer can explain the implications of the agreement, ensure that both parties' interests are protected, and draft the agreement in a manner that complies with UAE law.

5. Submission with Marriage Application:

Once the prenuptial agreement is finalized, it can be submitted along with the marriage application to the relevant authorities in Dubai. While there is no specific requirement for legalization or attestation, it's advisable to retain a copy of the agreement for reference in case of any disputes in the future.

Overall, while prenuptial agreements are not mandatory for civil marriages in Dubai, they can provide couples with peace of mind and clarity regarding their rights and responsibilities.

By working with a qualified lawyer to draft and finalize the agreement, couples can ensure that their interests are protected and their wishes are documented effectively.
