Can I withdraw my hit-and-run case to cancel my visa and leave the country?

Dear Sir/Madam,

My car was hit in a hit-and-run incident in front of police personnel, and they asked me to file a case. So I did, and now it has been 5 months, but the case has not yet been resolved.

Now, I want to cancel my visa and leave the country. Can I withdraw my case due to this, and what could happen after?

The case has been at the prosecution stage for more than 3 months now.

If you could advise me on this, it would be greatly appreciated as I intend to start my studies abroad.

Dear Questioner,

Thank you for reaching out to me with your legal concern regarding the ongoing hit-and-run case.

I understand the urgency of your situation, particularly with your desire to pursue studies abroad and the potential impact of the pending case on your plans. Allow me to provide you with some guidance on your options moving forward.

Firstly, regarding the possibility of withdrawing your case due to your intention to cancel your visa and leave the country, it's essential to understand the implications of such an action.

Withdrawing a case can be a complex process and may have consequences, especially if the case is already under prosecution.

While it is technically possible to withdraw a case, the decision ultimately lies with the prosecution authorities.

You would need to formally request the withdrawal of the case, providing valid reasons for your decision.

However, it's crucial to note that the prosecution may not always grant such requests, especially if there is significant evidence and public interest involved in the case.

Additionally, withdrawing the case may not necessarily resolve your legal obligations or liabilities arising from the hit-and-run incident.

The other party involved may still pursue civil claims against you, and withdrawing the criminal case may not protect you from potential civil consequences.

Before making any decisions, I strongly advise you to seek legal counsel to fully understand the implications and explore alternative solutions that may better suit your situation.

As an experienced attorney in Dubai, I can provide you with personalized advice and representation tailored to your specific circumstances.

Please feel free to reach out to me via WhatsApp or phone to schedule a consultation.

During our discussion, we can delve deeper into your case, address any additional questions or concerns you may have, and outline a strategic approach to help you achieve your goals.

Dear Questioner,

Thanks for your inquiry!

According to UAE law, you have the right to withdraw your case at any time before the final judgment is issued.

However, the withdrawal of the case may not necessarily result in the cancellation of the proceedings. The prosecutor may continue with the case if there is sufficient evidence to support the charges.

If you decide to withdraw the case, you will need to inform the prosecutor's office in writing and provide a valid reason for the withdrawal. The prosecutor will then review your request and decide whether to continue with the case or not.

If the prosecutor decides to continue with the case, you may be required to attend court hearings and provide evidence to support your case. If you fail to attend the court hearings, the case may be dismissed.

It is important to note that withdrawing the case may also have an impact on any insurance claims you have made for the damages to your car.

You may need to inform your insurance company about the withdrawal of the case and they may require you to provide a valid reason for the withdrawal.

In conclusion, you have the right to withdraw your case, but it is important to consider the potential consequences before making a decision. It is recommended that you consult with a legal advisor before taking any action.

Please do not hesitate to contact us via phone or email.

Greetings,

Dear Questioner,

In the UAE, withdrawing a case requires approval from the police or prosecution. They may not readily agree, particularly for hit-and-run incidents.

Withdrawing the case could make it difficult to pursue compensation for damages to your car through insurance or legal means.

Contact the prosecutor handling your case, and explain your situation and your desire to leave the country.

Inquire about the possibility of withdrawing the case and the steps involved.

If you need further clarification, kindly contact me.
