New employer wants old visa cancellation, but there are labor dues. What now?

Dear Sir/Madam,

I have an ongoing labor case against my previous company where I used to work, as I was not receiving the salary for several consecutive months (more than 2).

I have obtained a new job that requires me to cancel the visa from my previous employer as they intend to provide a new permanent visa; they do not wish to continue with the temporary work permit.

However, I have a significant amount pending from my current employer, and I have heard that upon signing the cancellation letter, I will not be able to make any claims.

Please advise me!

Dear questioner,

You are required to report the issues of pending salary over MOHRE as soon as possible and then start your notice period stipulated in your contract.

The company is answerable for the pending salary and gratuity to you.

After receiving all the dues, you can sign the visa cancellation papers.

Dear Questioner,

It is recommended that you continue with your labor case against your previous employer and not sign the cancellation letter until you have received all the pending salary and any other benefits owed to you.
