How can I claim money I lent to my cousin to start business and is not returning back?
My cousin who lives in Dubai took around AED 280000 from me on December 2023 for business and he told me that within one month he would return the money back with profits.
Now it's been almost a year he has not returned my money back. I have no written contract. The only proof I have is WhatsApp chats, videos, and voice messages of him that he received money from me and that he would return it back within one month.
In August 2023 I told him that if you don't return my money, then I would hire a lawyer and do a case. Then his father returned almost 20% of the amount back in August 2023 and told me the remaining amount I would receive from them by the end of November or December 2023.
But now they are not giving me the money and telling me to go to the police or hire a lawyer, file a case do whatever I want to do.
Kindly please advise me if hiring a lawyer in Dubai will be helpful or not. Will I be able to recover my money in Dubai in a legal way in such a case?
Yes, you can get back your money plus late payment interest and you can request a travel ban for him also.
Call me please immediately.

Good Morning
If you have some evidence or proof (for example WhatsApp or text messages, witnesses, deposit slip…etc.), then you can file a case.
However, you can only claim for the loan amount to be returned as it is illegal for individuals to lend with interest and it is restricted to the banks or credit companies who are licensed by the central bank.
If you need more support and clarification, please contact us.
Kind Regards
The amount seems to be higher and you can file a case with the available evidence such as Whatsapp chats, videos, and proof of repayment of 20% amount to you.
There are possibilities for getting your money. The final decision will be at the discretion of the court.

If the written WhatsApp messages mention the amount and the phone number is Emirati and registered in your cousin’s name, you can file a lawsuit to recover the money.

Dear Client
Hope you are doing well.
I can assist you in this situation, if you have a transaction conversation on WhatsApp, we can file a civil case against him. WhatsApp conversations are admissible as evidence in the Court.
Also, I need to know if your cousin still resides in Dubai.
And did he take the money in 2022 or 2023?
You can send us a copy of your conversation or if you want, we can discuss this on a Zoom call.
If need be, you can contact us via WhatsApp or email.
Thanks & Regards

Dear Sir,
Upon the given information above, we can advise generally, as follows
1) Yes, the conversations exchanged between both of you are considered as evidence to prove your rights. However, we should study the documents that you have to decide the accurate process to start.
2) Absolutely, you have the right to appoint a lawyer in the UAE to complete the procedures until returning your money back.
If you have any other inquiries, do not hesitate to contact us.
