Form F says "No penalty". Can I still claim compensation if the buyer withdraws?
Dear Sir/Madam,
I signed an MOU (Form F) with a property buyer, and in the form, it says penalty type "NO."
Does this mean I can't claim compensation or recover a security cheque if the buyer refuses to proceed with the purchase after signing the MOU?
Dear Questioner,
In this situation, you can retain the security deposit if the buyer refuses to proceed with the sale.
In certain conditions, you also have the right to claim compensation. The legal implications of an MOU can vary based on jurisdiction and the specific language used in the agreement.
However, it would be advisable to review the MOU for further clarification.

Dear Questioner,
Yes, normally you can claim the security cheque amount.
It will be according to the clauses mentioned in the MOU. But normally, if the buyer cancels the transaction the, seller has the right to retain the amount of the cheque deposited by the buyer.
We have to review the document to advise you of all the possibilities. After that, we will arrange a legal consultation session for a charge.

In regards to the penalty type marked as "NO" in the MOU, it typically implies that there is no predefined penalty clause for a specific breach.
