Can I file a civil case for bad faith related to a criminal case ongoing before public prosecution?

Before the conclusion of the criminal complaint in the public prosecution, can we file a civil case against the complainant to ascertain the complaint was lodged by the complainant on mala fides and bad faith to harm the defendant?

Dear Client,

Thanks for your question, I hope you are doing well. I will definitely assist you in this matter.

In the UAE, it is possible to file a civil case alongside or after a criminal complaint. A civil case is a separate legal proceeding from a criminal one, and it deals with issues related to compensation, damages, or other civil matters.

If you believe that the criminal complaint against you is malicious and in bad faith, you can consult with us and file a civil case to seek compensation or other remedies for any harm caused by the complainant.

For any further legal assistance, you can WhatsApp us. We have an extensive team of knowledgeable and experienced lawyers to provide the legal assistance you need.

We will definitely be happy to help you.

Thanks & Regards

Yes, you can do that. But whether this course of action is the most suitable in your scenario or not depends on the specific situation and the details of the case you are referring to.

For more information, please contact us on WhatsApp.

Thank you for reaching out with your legal inquiry. I understand the importance of addressing concerns related to potential malicious and bad-faith intentions behind a criminal complaint.

In response to your question, it is indeed possible to file a civil case concurrently with the ongoing criminal complaint.

Filing a civil case allows you to seek remedies such as damages or injunctions independently of the criminal proceedings.

It's crucial to note that the civil case focuses on the harm caused to you, separate from the criminal charges you may be facing.

To discuss the specifics of your situation and explore the best approach for your case, I recommend scheduling a consultation.

During our meeting, we can delve into the details, assess the merits of your potential civil case, and outline a strategy tailored to your needs.

Please feel free to reach out to me via WhatsApp or phone to schedule a consultation. I am here to provide the guidance and support you need during this challenging time.

Best regards,

Would filing this civil case provide me relief in a way to lift my travel ban as I have professional commitments with my employer?

22 Nov 2023, 09:22

I appreciate your follow-up question and completely understand the urgency of your situation, especially concerning your professional commitments and potential travel ban.

While filing a civil case can address the harm caused by the criminal complaint, its direct impact on a travel ban may be indirect.

Travel bans are typically associated with criminal cases, and civil proceedings may not automatically lift such restrictions.

However, it's essential to consider that success in a civil case could positively influence the overall legal landscape, potentially providing grounds for discussions with the relevant authorities to reconsider or lift any travel restrictions imposed.

Success in proving malicious intent or bad faith in the civil case might contribute to a more favorable outcome.

Feel free to reach out to me via WhatsApp or phone to schedule a consultation at your earliest convenience.

I am here to assist you in navigating through these challenges and finding the best possible solution.

Best regards,

Suhail Rana

No. After the end of the criminal case, this is possible, and within a very limited scope.

Yes, you can initiate a civil case, but it is the court's discretion to decide the case before the judgment of the criminal complaint.

So it is advisable to wait until the decision of the criminal case.

Yes, there is a possibility to file against the complainant and it can be accepted by the court. If you want, we can provide you with the service.

If we have adequate proof to establish that the complaint so filed is malafied, then we can claim the compensation as well.

Share your WhatsApp number if you want to go with our services.

Dear Inquirer,

Hope you are doing well!

Kindly note that it depends on the criminal offense, however, you can file the civil case parallel with the criminal case.
