Would a minor have a share in all properties, or be given a particular property?
Dear Sir/Madam,
My father died recently. We are Muslims living in Dubai, UAE. I have siblings, including a minor who is 16 years old. My father had land and vehicles under his name.
If I am applying for an inheritance, does the minor need to have a share in all the properties and vehicles, or can she be given a particular property?
Second, if we want the land to be in her name, can she manage it (like renting and banking) or does it require an adult?
I want to ask the same for transferring the vehicles.
Your guidance will be very much appreciated!
Dear Questioner,
Thank you for raising your concern, however, I would advise you to kindly book a consultation to discuss this further in detail.
Inheritance for Muslims is not straightforward and in your case which involves a minor, it would be better to book a consultation and discuss in detail the complete scenario.
Dear Questioner,
Minors have the right to own property in the UAE, however, they must have a guardian to manage their property on their behalf.
This guardian can be a parent, a legal guardian, or a trusted adult appointed by the court.
Dear Client,
Thanks for your question!
I hope you are doing well. I will definitely assist you in this matter.
- The minor is entitled to a share in all properties and vehicles as determined by Islamic inheritance laws; specific properties or vehicles cannot be designated to her alone.
- Property management for the minor typically requires an adult guardian until she reaches legal age.
- Vehicle transfers should follow UAE regulations, and it's generally not advisable to transfer them without considering legal and financial implications.
