Senior executive unfairly dismissed: How much compensation to claim?
Dear Sir/Madam,
I have been unfairly dismissed (it's personal on their end) and have been given only two months' salary apart from the compulsory gratuity and notice pay.
I would like to claim more than two months as I am a senior executive (Director).
Up to how much should I claim, and would this be a realistic amount for me to "win"?
Dear Client,
Thanks for your question! I hope you are doing well. I will definitely assist you in this matter.
In the UAE, labor disputes and claims for unfair dismissal are typically handled through the Ministry of Human Resources and Emiratisation (MOHRE) and the labor courts.
The specific amount you can claim for unfair dismissal can vary depending on several factors, including your salary, length of service, and the circumstances of your dismissal.
As a senior executive, your claim may be higher than that of lower-level employees. However, there is no fixed formula for calculating the compensation for unfair dismissal, and it often depends on the evidence and arguments presented during the dispute resolution process.

Hi,
If it is arbitrary dismissal, then you are entitled to 3 months' compensation, but we need to review all your documents to confirm.
Please contact the legal coordinator via phone for more information.
Dear,
I understand your concerns regarding your recent dismissal and the subsequent compensation you've received.
Unfair dismissals can be quite distressing, especially when one feels that personal biases influenced the decision.
Regarding your query, it's important to highlight that under the latest labor law reforms, the provision for arbitrary dismissal compensation has been abolished.
However, there exists another article addressing illegal termination and the potential compensation that may arise from such scenarios.
For us to provide a well-informed assessment of the amount you might claim, and to gauge the likelihood of a favorable outcome, it's crucial that we have a comprehensive understanding of the following:
- The specifics of your termination: Details regarding the reasons given for the dismissal, any prior warnings or discussions, and the overall process of termination.
- Your employment contract: This will offer insights into the terms agreed upon at the onset of your employment, which will be pivotal in understanding any deviations or breaches.
- Surrounding circumstances: Any additional factors or events that might have influenced or led up to the decision to terminate your employment.
With a clear vision of the aforementioned details, we can better advise you on the potential compensation claim, considering your position as a Director, and determine the realism of a successful outcome.
Please provide the necessary information, and we'll guide you through the next steps. Your interests are paramount to us, and we're here to support and assist you throughout this process.
