Can children of an absconded UAE citizen claim financial support in the UAE?

Hello,

My father is a UAE citizen and my mother is British. I live in the UK with my mother and brother, as my father absconded when we were young.

He has always refused to pay towards our care and does not respond to our attempts to contact him.

His name and signature are on our British birth certificates, and my mother has a nikkah marriage certificate that was obtained in the UK.

Please could you advise if we have any rights in the UAE as his children?

We have been told that we could travel to Abu Dhabi to open a case against him in court, however, this is not financially an option for us.

Dear Questioner,

Yes, you have the full right to ask your father for alimony.

How old are you? Do you have siblings?

18 Jun 2023, 10:07

I’m 18, my brother is 15.

18 Jun 2023, 10:15

If you are more than 18 years, you can file a case by yourself.

For your brother, your mother should file a case on behalf of him.

Dear Questioner,

You have a long way to go, but it's worth it.

Yes, you have rights over him because you are his children, and rights because you are Emiratis.

Dear Questioner,

Considering that you are the children of an Emirati citizen residing in the UAE, you can claim child support and other rights assigned to the Emirati citizen, and in order to claim these rights, you can authorize an Emirati lawyer to submit this request and follow it up on your behalf.

Thank you for your response!

How would we do this, please?

We do not have any paperwork to show. We are local, and traveling to Abu Dhabi to file a court case against him would be costly.

Is it possible to have someone represent us in court?

18 Jun 2023, 11:10

Yes, we can represent your mother in court considering that your mother has custody.

For this representation, we can help with an online power of attorney. We need a copy of your mother's passport, and to prove you are his children, you should provide us with a copy of your birth certificate and your mother's marriage certificate.

Good day,

Hope all is well!

Yes, as long as you have the proper marriage and birth documents, we can open a case and ask for alimony for all the previous years as well.

18 Jun 2023, 11:00

Our UK birth certificates are legal documents with his signature on them. However, the Nikkah marriage is not legally recognized here in the UK, it's just paperwork to show that the Imam provided the Nikkah marriage at the mosque.

18 Jun 2023, 11:34

The nikkah paper is just a custom thing. Get it attested if you have the original and we will be able to file for it.

Text me on WhatsApp and let me have a look at it, please.

Have a good day!

Hello dear questioner,

You can obtain Emirati nationality from your parents and obtain the entitlements of all the fostered children.

Because you are unable to travel, you must appoint a lawyer specialized in these matters, and according to the agency organizing this in your name, they can pursue matters judicially in the country.
