Q: Dear Lawyer, A company in Jebel Ali filed a case of fraud at Police station. The company asked me to pay a certain amount after adjusting against my final dues. I paid and cleared. Later on, they started blackmailing me by asking me to pay the legal costs incurred by the company. Then I complained to the Ministry of Labor saying that my passport is held by the employer. Now the Police station has transferred the case to the public prosecutor along with my passport on 10th of April. I need to know how long will it take for the hearing to happen (waiting for the call from the Dubai Court) and secondly can the employer withdraw the case when it is with public prosecution? If yes how? Please advise. Regards, Francis

س: لقد كانت هناك شكوى جنائية ضدي أنا وزوجي، وتحفظت النيابة العامة على جوازات السفر الخاصة بنا. بعد مرور 8 أشهر من التحقيقات، قررت النيابة العامة توجيه التهم ضد زوجي فقط، وأعطوني جواز سفري. هل يمكن أن أرفع قضية ضد الشاكي بسبب المضايقات التي واجهتها لمدة 8 أشهر والصدمة النفسية التي مررت بها؟ تم رفض طلبي بتبديل جواز سفري بجواز سفر شخص آخر أربع مرات دون إعطاء أي سبب خلال هذه المدة، ولم أستطع السفر حتى حينما كان ابني وأمي في حالة إعياء.

This person is blackmailing her by threatening to tell her husband, but is not asking for money. If my friend goes to the police about the blackmailer, can she be arrested for adultery as a backlash?

This Law promulgates the Federal Penal Code (Criminal Law) of the United Arab Emirates. Crimes and chastisement punishments shall be determined in accordance with the provisions of this Law and other penal codes.
