The UAE ban: types, terms and exemptions

I was working with a company in Dubai.

As I got termination with the company I was trying for another job. Unfortunately, I had debts for the credit card and the bank filed case against me.

My friends told me that I will get only a few months punishment if I surrender to the police. In addition, I don't want to pay back to the bank.

I surrendered there to the police and they took me to the court. The court sentenced me a month and they released after that, then the police took me to the immigration jail as they informed me that my company put my name on the absconding list.

I was there at the immigration jail till I arranged my ticket, and they deported me to my country upon arranging the ticket with a lifetime ban from entry to the UAE.

How can I lift my lifetime ban as it wasn't my mistake? Please reply.

With the eye scan and fingerprint taken by the authorities, it is impossible to re-enter the UAE if one has a permanent/ lifetime ban whether as a visitor or for residency.

There are THREE types of ban viz. labour ban, lifetime/ permanent ban, and immigration ban.

LABOUR BAN

If you have a visa and if you did not complete one year of service, an automatic SIX months or ONE-YEAR labour ban may be imposed by the Ministry of Labour upon request by your employer.

No employment visa shall be issued to you until the period of the ban is completed.

The basis of application:

Limited contract: failure to complete the term OR provide/ complete the notice period, one-year ban.

Unlimited contract: failure to provide or complete the notice period or terminating the contract/ resigning from the job before one year the contract, 6 months to one year.

PERMANENT BAN

Permanent Ban: applicable for serious offences such as illegal/ criminal activity or absconding. With the eye scan and fingerprint taken by the authorities, it is impossible to re-enter the UAE if one has a permanent ban whether as a visitor or for residency.

IMMIGRATION BAN: An immigration ban means you cannot enter the UAE, whether as a visitor or for residency. Israeli citizens, for example, are banned.

Ban MAY NOT be imposed in the following cases:

- Expatriates who are sponsored by their spouse for a residence visa

- Expatriate workers moving into a government job will not be banned

- Moving to the same free trade zone

- Employees who work in an oil company may not be banned

- Expatriates who have completed a fixed term contract, and have submitted proper resignation notice

- Expatriates who have completed the one-year term of an unlimited contract, AND hold a NOC from the current employer

- Expatriates who have worked for a company for more than three years on an unlimited contract.
